Terms of Service

PLEASE READ THESE TERMS CAREFULLY. They contain an arbitration agreement and class action waiver that affect your legal rights. By using our Service, you agree to resolve disputes through binding individual arbitration and waive your right to participate in class actions.
1. Acceptance of Terms
By accessing or using AccessibilityScanner ("Service", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.
These Terms constitute a legally binding agreement between you and AccessibilityScanner. Your use of the Service constitutes your acceptance of these Terms and creates a binding contract.
2. Eligibility
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You are not prohibited from using the Service under applicable laws
- If using on behalf of an organization, you have authority to bind that organization
3. Description of Service
AccessibilityScanner provides automated website accessibility analysis tools that help identify potential WCAG (Web Content Accessibility Guidelines) compliance issues. Our service includes:
- Automated accessibility scanning using axe-core engine
- Integration with WAVE API for enhanced analysis
- AI-powered recommendations (available on certain plans)
- Lighthouse performance and accessibility audits
- PDF report generation
- Scheduled automatic scanning
IMPORTANT DISCLAIMER: Our automated scans are tools to assist in identifying potential accessibility issues. They do NOT constitute legal advice, do NOT guarantee WCAG or ADA compliance, and do NOT replace professional manual accessibility audits, user testing, or consultation with accessibility experts and legal counsel. The Service may not detect all accessibility barriers.
4. User Accounts
4.1 Account Registration
You must provide accurate, current, and complete information when creating an account. You agree to update your information to maintain its accuracy. Providing false information is grounds for immediate account termination.
4.2 Account Security
- You are solely responsible for maintaining the confidentiality of your account credentials
- You are fully responsible for all activities that occur under your account
- You must immediately notify us at security@accessibilityscanner.top of any unauthorized use or security breach
- We are not liable for any loss or damage arising from your failure to protect your account
- You may not share, sell, or transfer your account to any third party
5. Subscription Plans & Payments
5.1 Free Plan
Free accounts receive 10 free scans per day with basic accessibility scores. Free scans provide limited information and do not include detailed issue reports, AI recommendations, or PDF exports.
5.2 Paid Plans
- Starter ($29/month): 30 credits/month, full analysis reports
- Pro ($49/month): 75 credits/month, 1 auto-scan project per week
- Business ($99/month): 200 credits/month, unlimited auto-scan projects, AI-powered insights
5.3 Credit System
- Full Analysis (new page): 5 credits
- Rescan (same page): 2 credits
- Auto-scan: 2 credits per page
Credits reset at the beginning of each billing cycle. Unused credits do not roll over to the next billing period and have no cash value.
5.4 Billing & Automatic Renewal
Paid subscriptions are billed monthly in advance. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You authorize us to charge your payment method on a recurring basis.
5.5 Refund Policy
All subscription fees and credit purchases are non-refundable, except as required by applicable law. No refunds will be provided for:
- Partial months of service
- Unused credits or scans
- Downgrade to a lower-tier plan
- Account termination for Terms violation
5.6 Price Changes
We reserve the right to modify pricing at any time. Price changes will be communicated at least 30 days in advance and will apply to the next billing cycle.
6. Acceptable Use Policy
You agree NOT to:
- Scan websites you do not own or have explicit written authorization to scan
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to our systems, networks, or other users' accounts
- Interfere with, disrupt, or overload the Service or its infrastructure
- Use automated bots, scripts, or tools to access the Service beyond normal API usage
- Resell, redistribute, sublicense, or commercially exploit the Service without written authorization
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove, alter, or obscure any proprietary notices or labels
- Use the Service to transmit malware, viruses, or harmful code
- Harass, threaten, or harm other users or our personnel
- Misrepresent your identity or affiliation
- Use scan results to harm, defame, or extort website owners
Violation of this policy may result in immediate account termination without refund and may be reported to appropriate authorities.
7. Intellectual Property Rights
7.1 Our Intellectual Property
The Service, including all content, features, functionality, software, text, graphics, logos, and trademarks, is owned by AccessibilityScanner and protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes, subject to these Terms.
7.3 User Content
You retain ownership of any data you submit to the Service. By using the Service, you grant us a worldwide, royalty-free, non-exclusive license to process, store, and analyze submitted URLs and scan data solely for the purpose of providing the Service.
8. Third-Party Services
Our Service integrates with third-party tools and APIs, including but not limited to:
- WAVE API (WebAIM)
- Anthropic Claude AI
- Google Lighthouse
- axe-core (Deque Systems)
- Payment processors (e.g., WayForPay)
These third-party services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or reliability of third-party services. Our Service may be affected by changes, outages, or discontinuation of these third-party services.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, COMPLETENESS, OR RELIABILITY OF RESULTS
- UNINTERRUPTED OR ERROR-FREE OPERATION
WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT:
- Scan results are complete, accurate, or free from errors
- Using our Service will make your website ADA, WCAG, or otherwise legally compliant
- The Service will meet your specific requirements or expectations
- Any errors in the Service will be corrected
- The Service will detect all accessibility issues
Automated accessibility testing is inherently limited. Many accessibility issues can only be identified through manual testing and real-user evaluation. You should not rely solely on our Service for compliance determinations.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACCESSIBILITYSCANNER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business opportunities, or goodwill
- Cost of substitute services
- Any damages arising from ADA lawsuits, compliance failures, or regulatory penalties
- Any third-party claims or demands
- Unauthorized access to or alteration of your data
- Service interruptions, delays, or failures
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless AccessibilityScanner and its officers, directors, employees, agents, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your violation of any applicable laws or regulations
- Any content or data you submit to the Service
- Websites you scan without proper authorization
- Any claims that your use of scan results caused harm to third parties
We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense of such claims.
12. Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
12.1 Informal Resolution
Before initiating any legal proceeding, you agree to first contact us at legal@accessibilityscanner.top and attempt to resolve the dispute informally for at least 30 days.
12.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitration shall be conducted by a single arbitrator in the English language. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
12.3 Class Action Waiver
YOU AND ACCESSIBILITYSCANNER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
12.4 Exceptions
Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction for infringement of intellectual property rights or other equitable relief.
12.5 Opt-Out
You may opt out of this arbitration agreement by sending written notice to legal@accessibilityscanner.top within 30 days of first accepting these Terms. The notice must include your name, address, email, and a clear statement that you wish to opt out.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware.
14. DMCA & Copyright Policy
We respect intellectual property rights and expect users to do the same. If you believe content on our Service infringes your copyright, please send a DMCA takedown notice to:

- Identification of the copyrighted work
- Identification of the allegedly infringing material

- A statement of good faith belief
- A statement of accuracy under penalty of perjury

15. Termination
15.1 Termination by You
You may cancel your account at any time through the dashboard settings or by contacting support. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.
15.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Fraudulent, abusive, or illegal activity
- Non-payment of fees
- Extended inactivity
- At our sole discretion
15.3 Effect of Termination
Upon termination, your right to use the Service immediately ceases. We may delete your account data within 30 days. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and arbitration) will survive.
16. Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, pandemics, shortages of transportation, facilities, fuel, energy, labor, or materials, failure of third-party services, or internet or telecommunications failures.
17. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 30 days before taking effect.
Your continued use of the Service after the effective date of changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and close your account.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and AccessibilityScanner regarding the Service.
18.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
18.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.
18.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
18.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
18.6 Headings
Section headings are for convenience only and have no legal effect.
18.7 Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations, including the U.S. Export Administration Regulations and sanctions programs administered by OFAC.
19. California Residents
If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA). Please see our Privacy Policy for details. Per California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice:
